Most of the Company’s products are on a Federal Supply Schedule (FSS) contract. Also, most of the Company’s products are reimbursed under the Medicaid Drug Rebate Program and/or Medicare Part B. As a result of the preceding, for each covered product, the Company is required to both manage several government contracts in strict compliance with laws AND (at statutorily defined intervals) calculate, certify and submit to the government, statutory price calculations, such as Federal Ceiling Price (FCP), Non-Federal Average Manufacturers Price (NonFAMP), Average Sales Price (ASP), Average Manufacturer Price (AMP) and Best Price (BP).
Both the FSS contract’s price reductions clause obligations and statutory price calculations are derived from each product’s commercial contracting and pricing transactions (and takes into account anything the government considers a price concession). The CEO (or the CFO) of the Company, under governing regulations, is accountable for the truthfulness, accuracy and completeness of certified calculations and submissions. The failure to flawlessly execute government contracting and price calculations could lead to severe government sanctions including but not limited to debarment from participation in government programs (meaning, customers receiving any federal program reimbursement will no longer purchase products from a debarred company). The position of Senior Director, Commercial and Government Pricing Operations is responsible for coordinating and managing the critical activities throughout the entire commercial and government contracting continuum to drive compliance while supporting the sales force’s focus on the customer.
| | Duties: | Essential Duties & Responsibilities:
Responsible for: (a) actively interfacing with brand teams, Managed Care and Sales Operations to accurately analyze and project impact of commercial product pricing strategies on government pricing obligations and (b) coordinating the activities relating to the tactical implementation of these strategies to the extent they impact government price calculations. Participates on the US Pricing Committee and assures accurate implementation of key decisions’ impact on government reporting and pricing. Coordinate all activities related to government and commercial contract development which includes: creating and maintaining appropriate contractual language; assuring adherence to policies and procedures such as approval requirements, pricing guidelines and conformance with accepted contracting practices; accurately administering in a timely fashion the contract obligations; and enforcing a commitment to systems technology to automate, monitor and audit contract activities. Assure compliance with government rules and regulations. Set expectations for contracting excellence to include a commitment to high quality, ethical deliverables.
Strategic Price Management and Principal Tasks:
• Responsible for managing the day-to-day operations of the US Pricing Committee.
• Collaborate with other business leaders on pricing strategies across company products and channels/market segments (MCO, PBM, GPO, hospital, physician office, specialty distributor, wholesaler, pharmacy and specialty pharmacy, Medicaid, Medicare and Big 4/OGA).
o Analyze impact of price changes on government pricing such as ASP, AMP and Best Price.
o Analyze impact of price changes regarding FSS contract
• To the extent they impact government price calculations, coordinate the tactical implementation of contract strategies consistently across customers and market segments assuring appropriate processes are followed and approvals gained.
• Embrace the concept of continuous improvement; evaluate and proactively propose revisions to contracting processes and procedures to increase efficiency and clarity within process, to the pricing committee.
• Coordinate the development of contracts across all channels, ensuring alignment with product goals; advise team on contract development and approach to handling situations.
• Secure compliance with government regulations, state and federal laws, and company policies and procedures.
• Develop, maintain and enhance relationships with Managed Care and Sales teams.
• Ensure the creation of financial analyses and scorecards to adequately forecast, monitor and trend government contract customers’ performance across products; communicate accrual forecasts to Finance and justify variances.
• Coordinate the timely and efficient processing of contract obligations including rebates and discounts as well as the appropriate and optimal use of the contracting system including contract implementation and membership maintenance.
• Oversee the management of outsourced functions such as chargebacks.
• Ensure the creation and timely upkeep of Standard Operating Procedures for contract development and contract operations processes and cycles.
Statutory Price Reporting and Government-Specific Job Responsibilities:
• Understand the rules for doing business with the federal government and develop a relationship with the assigned FSS Contracting Officer at the VA.
• Negotiate and implement FSS contracts and subsequent modifications with the VA including BPAs and National Contracts.
• Oversee and monitor FSS Price Reductions Clause obligations.
• Oversee federal product programs and assure company compliance with federal government regulations.
• Oversee compliance with state product price reporting laws (VT, ME, NM, TX).
• Evaluate, assess and propose strategy for all new government programs.
• Interpret implications on federal product programs of all commercial contracting programs.
• Evaluate, analyze and recommend contracting strategies for state-initiated programs including supplemental Medicaid rebates and SPAPs.
• Review and approve all government calculations and payments prior to submission, e.g., FCP, ASP, AMP, BP, NonFAMP and Industrial Funding Fee payments.
• Assure accuracy and timeliness in the processing of quarterly state Medicaid rebates; investigate and resolve disputes.
• Oversee preparation of monthly and quarterly filings and refilings of BP and AMP; review filings prior to submission for reasonableness and investigate and resolve potential anomalies.
• Oversee participation in PHS 340B pricing on a quarterly basis; review pricing prior to distribution for reasonableness and investigate and resolve potential anomalies; manage outsourced functions like membership.
• Coordinate obligations under the TriCare Retail Rebate Program.
• Perform ad-hoc analyses to evaluate and report FSS Price Reductions Clause, ASP and Medicaid impact based on proposed pricing changes.
• Perform product and market analysis with government market segments to examine and improve performance and profitability.
• Maintain records in accordance with records retention laws and regulations, including the Medicaid Drug Rebate Program 10 year rule. | | Qualifications: | Education and background requirements:
• A minimum of ten years of experience in the pharmaceutical industry in roles related to pricing and contracting (government and commercial) required
• A minimum of eight years of experience as head of a contracting department handling both commercial and government contracting and pricing within the pharmaceutical industry.
• BA/BS degree preferred, but not required.
